By applying for an OneVerify membership ID you agree to the following terms and conditions. These terms and conditions will continue in effect throughout your OneVerify membership and after any termination, cancellation, or expiration. Please read these terms and conditions carefully.

1. OneVerify gives you one year access to all regular sites, plus seven day trial to all our Premium and 30+ Pay sites for four dollars and ninety-five cents ($4.95). If you chose to keep your membership to our Premium and 30+ Pay sites beyond your seven day trial, you will be charged the standard monthly rate of thirty-nine dollars and ninety-five cents. If you decide to cancel your trial membership to our Premium sites, you still have access to all our Regular sites for one full year.

2. Applicant represents and warrants that he or she is at least eighteen (18) years of age or twenty-one (21) years of age if he or she resides or accesses the internet in states, provinces or countries where eighteen (18) is not the age of majority.

3. Applicant affirms and warrants that he or she is the valid holder of the credit card used to purchase the OneVerify membership ID.

4. Applicant acknowledges and understands that the OneVerify membership ID will permit Applicant to access independently owned and operated websites which may contain explicit adult oriented materials that are not suitable for minors including, but not limited to, sexually explicit acts, depictions and descriptions of graphic nudity, simulated or actual sexual acts, masturbation, and homosexuality (referred to herein as "adult materials").

5. Applicant acknowledges and understands that OneVerify provides a adult website search service and that OneVerify does not own, operate, control, endorse, sponsor, promote, communicate, or otherwise distribute adult materials.

6. Applicant represents and warrants that if Applicant accesses any adult materials that it is legal for the Applicant to receive and view same and that Applicant will not use the adult materials in any unlawful manner including, but not limited to, unlawful transmission, display to minors and infringing on the intellectual property rights of owners or licensees of the adult materials.

7. Applicant acknowledges and represents that he or she knows and understands the laws concerning adult materials in the location where he or she resides and/or views same and accepts responsibility for his or her actions. Applicant will not apply for an OneVerify membership ID or view adult materials in any location where same could reasonably constitute a violation of any law, regulation, rule, or custom.

8. Applicant, upon approval, will be given an OneVerify membership ID which will allow access to OneVerify websites for a specified period of time for which Applicant has enrolled and paid.

9. Applicant will not publish, disclose, distribute, or disseminate his or her OneVerify membership ID to any other person.

10. Annual memberships are nonrecurring. Prior to expiration, OneVerify will notify by email those who have purchased annual memberships of their renewal options. Applicants who have purchased a monthly membership ID and who choose not to renew their membership must notify OneVerify of their option not to renew within three (3) days of the (monthly) membership renewal date. Applicant authorizes OneVerify to charge any and all renewals to the credit card account originally provided.

11. OneVerify reserves the right to terminate a membership ID with or without notice if, in its sole discretion, it determines that Applicant has violated any of these terms and conditions.

12. All fees paid for a membership ID are nonrefundable in the event that the membership is cancelled by OneVerify for violations of these terms and conditions. If OneVerify determines that the membership ID was obtained by use of a credit card for which Applicant was not an authorized user, OneVerify will credit the credit card account and invalidate the membership ID.

13. OneVerify does not guarantee or warrant the compatibility of Applicant's equipment, computer, software, browser, server, or online service. OneVerify is not responsible for any interruption in service or inability of Applicant to access participating websites due to technical difficulties or other causes beyond its control.

14. Applicant agrees to indemnify and hold OneVerify harmless from any and all liability, damages, claims, actions, or causes of action (including all costs and attorneys' fees) which may arise out of Applicant's use of an OneVerify membership ID including, but not limited to, receipt, viewing, transmission or retransmission, or use of any adult materials or any violation of these terms and conditions.

15. Applicant accepts all responsibility and assumes all risk in using an OneVerify membership ID for access to any participating websites and for the use of any materials obtained from any participating website.

16. Applicant acknowledges and agrees that these terms and conditions may be changed, modified and/or amended by OneVerify at any time with or without notice.

17. Applicant warrants that all information provided to OneVerify is valid and true.

18. Applicant acknowledges and agrees that by applying for and accepting an OneVerify membership ID that these terms and conditions shall be construed under the laws of the state of Arizona and that jurisdiction and venue for any action to enforce, interpret or otherwise deal with these terms and conditions or any rights arising therefrom shall be in Pima County, Arizona.

19. Applicant acknowledges and warrants that he or she has read these terms and conditions and agrees to be bound by them as part of and in consideration of receipt and/or use of the OneVerify membership ID.
